Wills and Guardianship Clauses – Ask Jerry Remy If You Should Have One

Many people acknowledge that wills are an important part of life, but creating one is something people feel they can wait to do, especially if they’re healthy and plan to live a long happy life. The following story of famed Boston Red Sox announcer, Jerry Remy, may help illustrate the importance of being proactive and having the foresight to create a will.

Remy’s son, Jared, attacked and killed his girlfriend, Jennifer Martel, in late 2013, pleading guilty to her murder in May 2014. Jared and Jennifer had one daughter together; Arianna, and neither of them had ever drafted a will. Upon Jennifer’s death and Jared’s incarceration, their daughter was placed in foster care and an ugly custody dispute ensued between Arianna’s grandparents. Had the couple simply created a will with a guardianship clause, their daughter would have been cared for immediately by a family member of their choosing, instead of by a foster family. Eventually, the matter was settled between the families with a custody plan they all agreed on; however, there is no way to know whether the result is a reflection of Arianna’s mother’s wishes.

The mistakes of this tragic story illustrate the urgency and importance of preparing a will, and make a difference for those who still have time to prevent something like this from happening to their family.
